The ballbuster of the deal was that at the scene, both drivers told the actual events, as stated on the accident report...but, when their insurance companies called them to interview them, they changed their stories...I got a call from the insurance company, they say that they are closing the case and I'm responsible for fixing my trailer because "their driver was in control of his vehicle"...huh? This guy ran off the road, jumped a 6ft deep ditch, ran *through* a concrete wall/culvert, and then landed *in* our trailer...yet he maintained control of his vehicle? Suuuure he did...:confused:

UPDATE 12/3/07 3pm I spoke with the LT. from the PD and WOW!!!! They admitted the mistake and have suspended the officer for 3 weeks without pay. The board had recommended removal. the PD was able to keep him because of the Academy spoke highly of him and he being a newly sworn in officer(few months ago). The PD is sending a message to the others about this action and hopes it will be heeded. WOW!! I am glad he did not lose his job(in a way...) I know, I know, I am a whimp, but I put myself in his shoes and I would be greatful for a second chance. I hope this will make him focus about his career and 20 years from now make him say wow! I almost blew it.(sappy I know, but its Christmas).

well next step is to meet with the Risk Mgt. dept for the City and get all paid for. (I am not holding my breath, so my outlook might change from what I stated above......

I met another board member(greasemonkey) in the Grocery store parking lot, and MAN what a spotless 69 Chevy, bright orange. his daily driver. WOW! I can only dream. HeartRob would have been impressed(I think)

Dude, this is great news. The department has all but admited fault, and suspending the officer 100% implies it.
Have you figured a $$ amount you need to replace/recreate that burb?

talk is cheap get something in writing from the LT he can deny he said it this way when the law dept of your city refuses to subrogate your claim, and they claim they never said they would pay your damages you have a leg to stand on.. think of it as a police report of your accident by the police

wow that sucks something awful. It's a shame the lengths you are having to go to get any money out of it. At least he didn't hang just a little more left or things could be really bad for you.


PS - that gun kinda looks like a pellet gun to me, it looks like it has one of the twist things at the bottom of the grip to reload Co2. It may just be the picture though

I have a great idea, a wonderfully great idea (sorry, watched the "Grinch Who Stole Christmas with my nephew earlier)

get us the e-mail of the man who signs the check, we all send him an e-mail with a picture of our Burb and how much it is work, after a couple of thousand e-mails he'll be more than happy to pay you off.

if only there was a way to make the drunk driver pay for all the damage .
in a way he made more than one life misserable youres and the cop who i guess just didnt wanted to become the hardnose cop we all know and hate , he may thank god on his knees he didnt kill anyone .

Update:

The PPD have suspended the officer for 3 weeks no pay, I am waiting on the Risk Mgt Dept. from the City to send over their INS Rep for payment.

If that does not work the way I believe it should. I will ask to see the Dash Cam Video from the PO car the night he was cited for Careless Driving. Alittle birdie told me there is some interesting stuff on the tape. I will use that if need be.

I just talked to the City of Pensacola Ins Rep "Dawn
Vickery 800-767-9480 Ext 1410(She is here in
Pensacola)
She stated that they will not be able to offer any
coverage because the City of Pensacola Police Dept
and Risk Management Dept(Tom Mulroy 435-1613) have not
admitted responsibility and I would have to go after
Mr. Thomas Fletcher in a civil suit to recover damages
even though Officer Jonathan Cramer was Suspended for
3 weeks without pay. There is a Dash Cam Video of the
Citation Officer Cramer issued 11/24/07 at 2:24am in
front of Cabana's Lounge on 9th Ave. the video has
some very interesting things. I need to get a copy. he
was cited for Careless Driving and 16 minutes later
crashed into my fence and 3 cars. He was almost 3
times the legal limit .21

Sue them all get the tape file a $1,000,000 suit against the city for negligence and the problems you are haveing adjusting to living life and the perpetual cost of a shrink due to your fears of a drunk guy in a van with a gun driving into your yard and house and doing you and your family bodily harm.

I may be over the top but get the tape and go for blood

He's right, better get a lawyer. I read this and had hopes of this coming to a good ending..... It seams that's not going to happen, SUE THE CRAP OUT OF EVERYBODY INVOLVED! That just my humble opinion. David

I knw that this might seem silly to say, I know that most lawyers won't want the case because there is no instant cash for them. But maybe one of the universities in the area have a law program and may be a good resource as to where to go and what you can do to move this along to a reasonable end. I know that my girlfriends son did just this when he got into some trouble.

It gives the students real life experience and they actually bust their butt's digging and scrounging and some super great information. It's just a thought. Definately get the News media on your side.... it's your biggest asset. Especially now that they said they are not going to pay... put the monkey on their back. Use the public to pressure them....

Remember it's not an "us and them" it's "you against them" get the people that pay their salary's on your side...

What happened with regards to repairs on the other 2 vehicles? If the insurance company has authorized repairs on them, you can bet your bottom dollar they are going to try and subrogate their claim against the kid and the cop/city. Seeing as you still have unrecovered damages, you do need to make sure that USAA doesn't settle with anyone in any fashion that might impair your future rights of recovery for the suburban damages.

The Ins has repaired the 2004 Hyundai(sp) wife's car. I picked it up yesterday had to pay $500 ded. The 1998 GMC truck, I have to pay, I just got the estimate it is $3274.84 I have to pay it. INS wont, only had it on my policy for Libility....Doh! the Fence is $834, minus my $500 deduct.
So so far I am out $4274.84 not counting the Burb......and several days of work........... my In-laws said they will help with $$$. so I should be able to recoup in a few years.

As a former Police Officer, I hate to say this but you need to sue the city and the officer himself. I would expect the same if that was me and I #(*$*&% up the stop. I can possibly see if he was just at the limit and performed the officers Field Sobriety Tasks satisfactory but to be that far over that's just emabarassing.

Maybe I missed it, but did the officer actually get him out and have him perform FST's???

Talk with your homeowner's insurance, because the cars were
parked in your driveway and not moving it should cover the costs.

Atleast that's how it works here in Michigan.

I did, they said Motorized Vehicles are not included in Homeowners, Just the fence and concrete damage was covered.

I've done some checking and your vehicles aren't covered by your home owner's policy
if you have auto insurance policies for them.

Your best bet now is to hire an attorney and sue the city, hoping the city or it's
insurance company will want to settle out of court.

I saw the news tonight. They say the city is not liable even though the cop had just let the drunk drive off. I would check with someone on that one. It just seems wrong. I think that also if you were to go after the cop himself for the incident, the city or his union would probably end up settling on his behalf. Just some food for thought.
