Saw this eBay auction, isn't this a board members truck? If so, is this their auction, or is someone just using someone elses truck?

That is definatly his truck it is in his profile pic as well as a bunch of other shots he took and are in the "show us your short beds" post. I wonder if that is his auction I don't know him but am going to guess some one used his truck.

Yep that would be my truck... but that's not my auction. :) The seller must of picked up the picture from this site- I haven't posted any where else.

someone did the same thing with one of my pics oncem I replaced it with some porn and the guy was not amused....

That's what I was going to suggest. I saw where a guy was selling a car and linking to a pic that wasn't his. The owner of the pic inserted a pic of a wrecked car. That was amusing...:)

At least the seller isn't stealing bandwidth by using a photo you are paying to host on a website. That's why I usually put a little "slonaker.net" image in the corner of my photos. I started doing that after someone from another board started using an image from my site on his website. He wasn't even hosting the image. He was just stealing my bandwidth to put it on his site. :no:

How does a person go in and change that on EBAY... I don't have a clue?! I do agree with everybody's comments' above; it's pretty CHEAP/SH-TY to post a pic of anyone's truck; but in turn only sell a "new" hinge kit- due to his own personal truck got "destroyed"? WTF?

You can't really do anything with the photo (other than lodging a complaint with e-bay or whoever is doing the hosting of the photo) unless you are hosting the photo. N2TRUX mentioned putting up a photo of a wreck, but you can only do that if someone is using a photo that you are hosting. In that case, you substitute another photo with the same name on your website, and it shows up in the ad instead. You aren't hosting the photo, so you have no direct control over it.

I think I will go look through my logs and make sure no one is leeching from me. :)

i don't think you can do anything to his ad.it's created on his password protected account.however you could go to ebay and try to file a complaint.they do answer your emails in a few days,if you don't have an ebay account i can do it for you.another thing i would do is on every ebay listing you can email seller to ask a question.tell him that's a copy righted show truck and it will cost him for unauthorized use of that trucks pic and you have turned the matter over to your attorney.screw with the dude's head a little bit.

I went out and checked his other items for sale... he has it posted a couple of times. (2) seperate listings for door pins... he can't seem to buy/sell enough of them- buy's them for $15.00 and starts the bids at $1.00 :crazy:

yes, it is a very good looking truck and it is not misrepresented in the auction in any way and the pic wasn't copywrited and if it is your truck you should be proud to have someone use it as a tribute to your hard work and money spent as long as they aren't trying to sell it or misrepresent it and say it is theirs or whatever. have a good one

IANAL, but I don't believe that a lack of a copyright notice automatically puts something in the public domain. Regardless, it is rude to use someone else's work.

It is also being used in a misleading manner. That truck used in the ad is not in any way a part of the auction.

In other words, he's a jerk...

the picture is not copywrited, its just a pic on the web, and therefore is a public pic for anyone to use as they wish....plus its his avatar.. so it can be found with a google search outside of this forum

whether it is copyrighted or not and the guy may think its a compliment... its called respect.. either ask the owner if you can use it or atleast give credit when you post the pics. By the sound of it... this guy did neither..

Wouldn't it be funny if it came through his email account. I mean I wouldn't be the type of person that would send him free gay porn from a fake account, but there are those that might consider it...;)

if you take a picture of your truck and place it on the web for the whole world to see, you have no legal case of owning that pic, its not yours anymore

I think you are missing the point here.

Would you mind if LMC, Golden State, etc used a pic of your truck to sell their parts...without contacting you or asking for your permission...or better yet, compensating you for the money they are making at your expense?

I would, and I would venture to say 99% of the classic truck population would agree.

One more thing, what if this seller is a crook and ripping people off?? Would you want your truck associated with business transactions lke that? What if the person who got ripped off is local to you, and saw your truck in a parking lot all by itself, and decided to "get back" at you for ripping them off.

Any of this making sense, can you see our point?

The problem with that is that I would have to find free gay porn to send...and gay porn isn't something I care to browse for, look at, or even think about. Secondly, I assume he has my contact info...and I certainly don't want to get into a gay porn war.

What he is doing bugs me, but it wasn't done to me, and there is no point trying to prove my (or our) point to someone who obviously sees nothing wrong with using someone elses truck and picture to sell their product.

I guess for the guys that have done alot of upgrades and even frame off restorations they need to copyright all their pics. I don't fall into that catagory so oh well. Is there a fee to copyright pics?

My understanding is that labeling a document or photo as being copyrighted is sufficient. It does not prevent anyone from using it, but it does discourage them.

As far as I've ever heard, you don't need an official copyright for an image to be copyrighted. Just simply saying it's yours and being able to prove it's your picture is sufficient. I doubt ebay would do anything for you though.
