Is it worst when cold? Could be a problem with the latch arm, the arm doesnt completely come down into the gear every time. Mainly happens when someone lubes the latch assembly with grease. When cold, the grease will actually hold the arm from springing back down.
Another possibility could be a few missing or damaged coggs on the gear (the part of the gear that contacts the latch lever, not the striker).
