You might have been better off buying the item. If the item isn't as described you automatically have the insurance from ebay (for up to $100 IIRC) then you would have been out $15 + shipping if he refused to refund and it stunk. The thing about not paying at all means that you didn't have a chance to really determine that the part was not what you wanted, and he is right that officially the bid is a contract... good luck with it...
