Yes, you can disable VVT on an E38 with the tune only. For it to be deleted, then the actual parts need to be changed.
The e38 runs a separate TCM and can be used for just engine control, but you will lose control of things like DFCO, which uses the speed to control the decel fuel cutoff. They aren't crucial, but they can be nice to have for the sake of driveability.
