Angry What do I do if I lost the title to the truck???

It had a lien on the title and I got rid of the lien today. But I can't find my title and don't know where it is. What do I do

In SD, if you have a lien the people with the lien have the title. Call the bank that had the lien, chances are they have the title.

Re: What do I do if I lost the title to the truck???

The bank does not have any title. I asked my Aunt since my dad put her in charge of everything and she told me I had it. I don't even have it let alone find it.

The old title had a lien on it and if I get a duplicate will it have the lien still on it.

My dad put the lien on it so my mom could not get it, because the truck was in her name.

Sorry, I am a tard, I have no idea how I read North Carolina as New York.

If the title is in your mom's name, then you mom needs to get a new title. Why did your dad put a lien on it? Why didn't you just have your mom transfer the title to you?

That stuff was takin care of last year and my dad put close to 5,000-6,000 in it and they were going to get divorced. My dad got the ol truck because he graduated in 1970 and he got it from a guy at the DOT(people that drive them ugly yellow equipment) in the early 90's and its been mine since I was 4 or 5 years old and couldn't drive.

Re: What do I do if I lost the title to the truck???

I just finished taking care of a similar thing. Go to the DMV and get a duplicate title form with the lien release on the back.
Have the lien release part filled out and notarized then do the duplicate title part and pays your money and in 3 weeks you will get a new title with no lein.

Re: What do I do if I lost the title to the truck???

his mom is in jail as far as i recall, so that is not gonna happen. his aunt in in charge of the estate.

Travis you can go to the dmv and explain the situation and see what has to be done. I'm pretty sure since your Dad passed away that the lein is null anyway, if not whomever is in charge of the estate has the lein, being your Aunt whom would need to get the title for you. Issue is, if your mom is the title holder, she has to sign it over to you, in jail or not... unless someone is overseeing her and then that person would need to. The truck is legally your moms, no matter how you look at it.

My mom signed her name off the title 3 or 4 months before she went to prison.

Will they think somehow its stolen or something cause I have had some rotten luck here lately.

Call or stop by the DMV tomorrow. Sometimes you run into a total dud at the DMV, if you do, don't sweat it. Just try again the next day. Eventually you'll get what you need.

If she signed her name off the title, who was it given to (you and your aunt?) was it notarized when she signed it? Was it transferred out of her name?

Re: What do I do if I lost the title to the truck???

In missouri, who ever's name is on the title has to apply for a lost one. So it probably won't do you any good to apply. You need to go there and talk to someone to find out what you have to do. It doesn't matter if she signed the title or not. If you can't find the original, she might as well not have signed it at all. If your aunt is in charge of her estate, maybe there's something she can do to get the title.

Re: What do I do if I lost the title to the truck???

Your best bet would go to the DMV. I agree sometimes they are dumb and no nothing, BUT there have been times when I have found them knowledgable. The tittle for my 67 was originally in my wifes grandpas name in Montana, he passed away and the truck sat in the bone pile for 4 years, I resceud and had to get a tittle transfer in Idaho. For once the DMV in both states helped out. they walked me through the processes and I got a tittle. Sometimes the best thing to do is go and explain what is going on. They are not going to think you stole it, so don't sweat that.

Re: What do I do if I lost the title to the truck???

issue is if the title was never in his name, he can not ask for a new one here.

travis, I thought of you when I read this a few min ago. You had questions about medical and this and im sure many others. You should make a phone call tomorrow and get advice.

Does your aunt have power of attorney? You could ask DMV questions on the phone. They see situations all the time. They`ll only think it`s stolen if it`s been reported as stolen. You have the whole story to back you up.You are kin to the titled owner.

Re: What do I do if I lost the title to the truck???

If your aunt is incharge of your mom's estate, she should have power of attorney. Have your aunt apply for a lost title, here it's done at the tag office. Your aunt can then sign the title over to you. Should not be a problem. If all else fails, ck with a wrecker service and see how they acquire vehicles they have large storage fees on. You can apply for the same type of title, you show what you have put in the vehicle money wise, and also add for storage at a reasonable daily rate. It probably needs to be advertised and usually in 60 days you have a title in your name.
