Bumper bracket issue

Guys I am taking off my LARGE step bumper and adding a sport bumper to my stepside. Pulled the old bumper off and went to add the new(er) brackets. I can't get the inside bracket mounted due to the bed mount stud. The mount stud definitely doesn't look right, the stack of washer clued me in!



With the washers off I still can't sneak the mount by:



So my question is, Should I just cut that top horizontal part off of the bracket so that I can squeeze it past the bolt?

Also, what is this bracket on the driver's side?
