Is this moving company an agent for a national moving company like Wheaton or North American? If it is you should go over their heads to the parent company.

ITs a really bum deal, but there are lawyers out there who specialize in suing trucking companies, considering they ass ended another truck, It is their baby.

Anyone got a recommendation in the SF Bay area for a custom shop/body shop that can do the repairs and other projects I need to get done on the truck?

I'm looking for--

1. professional integrity
2. quality work

The most recent shop I was dealing with consistently failed to do what they said the would, so here I am.

I need an estimate for repairing all the moving damages ASAP since this issue has been dragging on so long. I also will want some other work done, unrelated to the moving damage... so there's an opportunity to build a customer relationship here. I haven't dealt with them in a while, but Scotto's Auto Body in Antioch has always done right for me & there work is 1st class.
Or, at least is was the last time I had some body work done.

i am a cdl class a driver. this company that hauled vehicles the owner told me that if i as the employee were to damage any vehicle i would have to pay for it but if it were the companys fault they would pay for any damages. but before they hauled any vehicle regardless they made the owner of the vehicle sign a contract and insurance for there vehicles for them to haul.

Thanks for the pointer. It looks like they're about 70 miles away (I'm near Half Moon Bay), so I may look for someone a little closer first. If I don't find someone, I'll give them a call.

10 months have passed, with lots of "promises," and even more "apologies," with assurances of "taking care of us."

This week, we got "final" notice that they were NOT going to honor their obligation to put the truck back into the condition it was before they damaged it when they have a vehicular accident in the truck that was towing the trailer. As an interesting note to their "final" letter, they offered the following request for referrals. In the spirit of good will, I decided to share their referral request to all my friends on this board. I'm not sure if i'm seeing stuff wrong, but it kinda looks like the frame might have taken a hit. In your pic between the door and fender, it looks crooked. Make sure you have that checked before any settlement happens. Sorry to see it happen though. It looks like you had ALOT of time into the sheet metal.

You and I haven't seen eye to eye on more than a few topics in the past, but this situation is different. We've both had unanticipated setbacks where the "responsible" parties won't do the right thing. Mine was a town owned diseased tree that fell directly on one of my trucks which the town's insurance company won't pay up for various reasons. I decided to just strip what I needed for a new project and sell the remainder to cut my losses rather than to fight "city hall". Your situation is different because it seems so cut and dryed, your vehicle was damaged while under their care. Plus you've got so much more into your truck that starting over just wouldnt be an option. Good luck, I hope karma rewards you in the end with your vision being fulfilled

As people like to say around here - Lawyer UP!!. I wouldn't settle for the denial of claim. They are clearly at fault unless you signed something that says they aren't responcible.

I got enough to cover the mechanical repairs to the front suspension... in other words, to make it drivable again. (I pooled that money with a lot of my own to swap out the old xmember for a DM and rack.)

The moving company sent a long letter explaining that they weren't responsible for this, that, and the other, even though the _2_ estimates I provided them clearly indicated specific damages and what needed to be repaired as a result (one body shop owner who dealt with them on the phone called them "lowlife thugs" for their efforts to beat him up over book parts prices and labor rates); even though, on the day of the accident (the day they delivered our goods), I took cam pics of all damages and immediately emailed them to the company as my wife was talking to them on the phone.

An important note: they were ALWAYS VERY POLITE, EMPATHETIC, and ACCEPTED RESPONSIBILITY... until it came time to pay up... then they abdicated. An attorney I spoke with said I had a rock-solid case, but that after likely winning in CA court, I would probably never actually be able to collect a dime because the company was likely hiding behind a half dozen dba names and ownerships (I have experience with this reality... anyone want to collect on a 17 year old judgement I have against a construction company in Texas? It's gaining 10% per year on the unpaid balance in interest... so it's probably worth $20k+ by now... I couldn't get the legal system to collect on it when it was only $5k).

That sucks. You could try suiing in smalls claims court. Then attempt to collect via till tap or you could also file a judgment lien with the secretary of state and record an abstract of judgment in the county they are located in. You might get paid in a few years.

As I mentioned in my post above, I've been down that road before. After getting the abstract, I even filed two writs of execution. The constable came back empty-handed each time. When someone is willing to put some effort into being a cheat, there are enough loopholes in the system to get away with some amazing stuff. Hint: Enron, Global Crossing, Andersen, Imclone, Tyco, Worldcom, Adelphia... and so on. A handful of people actually went to jail (most notably, the "vicious criminal," Martha Stewart). Most skipped all the way to the bank. Nobody got money owed to them.

My only real weapon is to share my experience as I've done here, and to take the moving company up on their offer to 'recommend' them to others. This post is now about my 'recommending' them to others... so if you have any questions about their services, please send them a fax, send them an email, or give them a call.
