Update for Ureckme or anyone interested...

Hey buddy, just checking in. I have not heard anything from you in a little bit. I wanted to give you an update on my collision drama. I never heard from Titan so I called them on Monday. They said they could maybe get somebody out to check out my truck by next week some time. I insisted on bringing it to them so I could get the process started, they agreed to see it on Tuesday. The adjuster was hard on the quote your shop wrote up, despite the fact that you guys are one of maybe 10 shops in town they recommend. Anyway I got lucky and the adjuster is an old truck guy and seemed to want to help me. They did quote me almost $200 shy of your shop's repair quote, but he gave me the name of a chromer that he used to get work done on his 65 Chevy. He allowed me more money to repair the bumper than it would cost to replace it (I liked that). He also said that if repairs were more than he estimated that I can just have the shop call him to work it out. He seems very reasonable, the insurance agt. however is going to try to screw me. He said that since I was making a left he may not be required to pay 100% since I may be "according to the law" a yet unspecified % at fault. He said that he will have to get back to me on it after he is able to "further investigate it". I have 2 friends that are lawyers one of which is very familiar in this area of law. She said that she will offer me any help she can for free. I guess since I gambled and refused to play the game I will just have to wait and see what happens. I think I am going to get my bumper fixed and replace my headlight door then I plan to take the rest as the begining of a body drop kit for the near future. I think that it is smarter to than paint matching 27 year old paint, I will just wait and paint it all at the same time. In the mean time it won't look too bad?
Maybe if I wait long enough I will have a garage to work in and just maybe I can con you into doing side work by helping you finish your truck first in my garage??? Ehhhh?

Don't be a stranger now,
Shawn

They all ways try to get you to admit to some guilt, and try to screw you. Thats why I wrote what I did. The Ins. Co. wants to save money. But the law is,( Back to pre accedent condission ) or you can get them for diminished value of your truck. Just tell the ins. co. any thing you dont get from them, You will get it from the driver in small claims court. Call the Ins. board of Arizona and see what your rights are.
Be a pain in there ( you no what ) and they will pay to get rid of you.
Sounds like your doing good. Good luck Remember none of its your fault

Thanks Bud, I am feeling pretty good about the whole thing at the moment. I am sure it will all work out. My friend said that they have a valid point due to Arizona putting a lot of responsibility on the left turn driver. She is still optimistic that they are just trying to see what they can get away with.

They all ways try to go with what there customers say, if its in there best interest. It saves them money if you can be blamed for part or all of it. Just keep telling them he hit you, he got the ticket, and its costing you money for every second you have to deal with it.
This is important, keep track of the time you have spent, phone calls, what was said, time away from work. Any thing you had to do differant because of the damage on your truck. Just in case. When its all over add it up you will find it costs way more than you got. They make it hard to get and keep holding it in frunt of you till you give up or take what little they will give.
Have your lawyer friend call them. lol. Matt

Angry Re: Update for Ureckme or anyone interested...

Good News Today? No, I got a call from Rolando at Titan insurance notifying me that my claim will be denied. The reason? The vehicle the guy was driving when he hit me was actually not the vehicle he claimed was covered. He claimed that he just bought it and had not yet notified the insurance company yet but, that was not exactly true either. The car has been in his name since April which does go slightly passed the 30 day limit he had to notify the insurance company. Wow, I am at a loss for words, I guess I am going to try to get the money out of him through the great court system we have here. I can pay to take him to court, they will rule that he is at fault and I am entitled to money and he will stiff me. Hmmm, well I am going to take him to court anyways. It's a principle thing.

Good luck with it. It sounds like you may have to chalk it up to a bad experience and move on....

No doubt it's frustrating. Even more so that you might have to let him get away with it. The question you have to ask, is it worth the time and hassle? Maybe you can research all this guys personal info and offer not to make it public if he pays you....

I have all his info. My cousin is a Phx Police Officer and he had an interesting idea. He said I should call the guy and offer to settle out of court. That actually sounds like a good idea, it may be worth a shot anyways. I could just say "hey I am going to sue you but, if you want you can just save yourself the trouble and pay me for the damage". It may work, maybe it won't? I am not quite ready to fix it at this time. We are moving and I am strapped for the cash. I am sure I will end up with a junk yard bumper, headlight bezle and the brackets you gave me for a while.

My wife is buying a new car when we get our bills caught up (May???) and it is agreed that I will take her old Honda for a few weeks (or months) while I dig into my truck. I was planning on taking that time to have the rear end and the tranny done up a bit. I also wanted to do the lowering then. I guess I can try to get away with adding body and paint on at the same time. She just graduated from ASU and started working for the first time in 4 years. The money situation is getting better by the pay check. Hopefully by then I can convince her that Jebb is going to fall apart without new paint

Do you have uninsured motoriest in your state? If so you can claim under that. Also if he had no insurance how did he get tags on the vehicle? Might be something for the local's to look into.
