Can't seem to win. Sideswiped.
Got hit by an 80 year old dude in a beat up 93 GMC on my way home tonight. He crossed into my lane in the middle of an intersection and stabbed the brakes. Now I have a nice set of creases running down the passenger door, cab corner, the length of the bed, and a pulled bumper. The real killer is that the cop wouldn't cite him for it either. No witnesses. I feel a HUGE insurance battle coming up.

That sucks.
But on the other hand, as long as you & the old guy didn't get hurt, it's on steel. A real, giant PITA, but still only steel. Good luck with your battles.

Re: Can't seem to win. Sideswiped.
Mostly I am worried that they are going to try and total the truck based on property tax assessments. I have been looking around all night for a comparable truck for sale. Guess what? Didn't find any. I figure it needs a door skin, quarter panel, bumper with brackets, and custom matching of the paint. I don't even have a clue as to what brand paint is on it. I haven't seen shop labor rates recently, but I am willing to bet that there is more than 2500 in damage. For me to replace the truck would cost over 7 grand.
I think I am more pissed about the cop not citing him than the accident itself. |

There is no consoling you at this point, but heres 2 things to keep in mind: 1) I bought my Wife a 2011 Camaro for her BD and 3 days later, someone backed into it in the Parking lot = $5004.27! 2) Your Story is why I'm going with "Agreed Value Insurance" through JC Taylor. Took 6 pictures of my Truck. Filled out the application and wrote out a check for the 1st years Premiums. Approx $268.00 for $13K of "Agreed Value". If its totaled or Salvaged, I get $13K, no questions asked. If I kept my Truck on my Farmers Policy, I'd have to fight them tooth and Nail, and would still only end up with probably $7K. Good Luck!

Bummer
Up here, it's illegal to change lanes in the middle of an intersection. Good luck.

Re: Can't seem to win. Sideswiped.
Sorry to hear. I hate it when the cops wont determine who's at fault or cite.
How is the determination of "totaled" or salvaged made though? I mean, if there is really 10k work of damage and they say its not totaled, then can't you still get screwed? Or, maybe they just cover any shop costs as long as it doesn't exceed $13k?? That may assure you don't get screwed. |

Re: Can't seem to win. Sideswiped.
get the accident report. Just becouse no one got a ticket, doesn't mean the guy isn't at fault.
It is pretty much illegal anywhere to change lanes in an intersection, let alone while someone is in the other lane. Who is the other guy insured with? |

The cop even let the guy get away with not providing a policy number, just a local agency name. I'm slightly pissed. |
