need help quick! with police

i disputed a speeding ticket last summer and my court date is january 12th, i got a call from the police today and the cop left a message for me to call him, he is requesting an adjournment(sp), i dont even know what that is? does he want to put off the court hearing or something? should i say yes or no to him? i know here in BC is a cop doesnt show up to court you win the case. maybe he cant make it when i have court so if i say no they will throw the case out, or should i say yes? please help

Yes he is wanting to postpone the trial.If I were you I would just show up at the set date.If he is not there then I believe that the case will have to be thrown out??Hey what phone call you never received the message

If your from a smaller town or city, I would work with the cop if you could. Just remember, he's still a cop, and if he sees you in the future, you may have to deal with him again.

My sentiments exactly, hes the one who wrote the ticket, if he can't commit to his responsibility then TOUGH LUCK. Thats why I like my caller display feature, screen the guy out until your court date.

Call the cop....Are you in the right? or just trying to beat the ticket? The cop could get a postponment from the court if he has too..He might be trying to make a deal..Im a firm believer in trying to do the right thing..it usually pays off more in the end..its a lot nicer to have a friend on the force..than an enemy

Whoa, there people. Did anyone notice that he lives in Canada? Got lots of totally different laws up there. Any advice you may give could be totally useless in Canada.

i would just pay the ticket,its only 115.00,is it really worth all the hassle,what if you have to take the day off of work to go to court....theres 100.00 at least in wages lost.

Here in California, cop doesnt show, case dismissed. If the laws the same up there avoid him at all costs. Yes you want to beat the ticket!

while this advice is good on the outset, you must also take into account the points associated with the speeding ticket and then the increase costs of insurance as a result of the conviction as well as any future tickets you may get. judges tend to base fines and penalties on the driving record. My advice is to try to beat any ticket any way you can any conviction comes back to bite ya in the @$$ in the long run

same thing happened to me with my stunting ticket and i live ina town of 3500 people the cop knew it was a bull**** ticket so wasnt overly concerned when it got thrown out. and me I saved $158

Talk to him, after all, you already have the ticket. By acting responsibly, and talking to him on a personal level, you 2 might work something out. He took the time to call you, when he could get the date changed without your agreement, so see what he has to say. You just told us you were not in the right, just trying to beat the ticket, so that tells me he was just doing his job. And like most cops, I'm sure he has a good memory, especially for people that screw with him.

It is very strange that a cop would contact you directly. Here, all postponements, continuances or other must go through the court and judge.
Be like a murderer calling the witness to inform them of a date change. I don't think so.

Not sure about Canada rules, but here's what I learned from my last ticket (June '03) when I was in the right:

I went to the courthouse and learned that no matter what, win or lose, I have to pay the court fees ($100-$150), AND the judge has the power to raise my $88 fine up to a maximum of $300 for the same offense. So if I won, it would cost me at least $100, and if I lost it could cost me up to $450.

I paid the $88 fine and left.

Here's some input from a different perspective. I've been a cop for over 18 years and have undoubtably given more tickets than you have recieved! I've never heard of a cop calling for an "Adjournment", but he may be looking for a "deferrment". This is when the case is held over for a year (or so) and if you have no additional infractions, the whole thing is wiped clean - just like it never happened. If you violate within the time frame, you get whacked double hard.
Don't count on not seeing him again in a town of 80,000. He caught you the first time on his regular beat - he will be in the same area for a long time. Unless you move to avoid a $115 ticket, you will cross paths. Another thing to consider - if you are driving a unique vehicle (something other than a 5 year old spam can), we do remember them.
My vote is to contact him and hear him out. You don't have to make any committments to him and you will have shown your maturity to him - might make the courts go easy on you. On my tickets, I note whether the violator was angry, friendly, apologetic, cooperative, or kissing my a**. Sometimes is makes a difference.

My initial reaction would be to avoid him & hope the ticket gets thrown out. But I think the right thing to do is call him up & see what he says. This method could go either way though. He may respect you for contacting him & give you a break or he could be a real hard a$$ & just want to postpone it so he can nail you when he has time to attend the hearing.

I'd call him. If he says he want's to postpone the trial, tell him you've already made arrangements to be off at work that day and you can't change that without missing TWO days of work. That way you've shown responsibility and told him it would be an undue hardship on you to postpone.
