Re: 72 Chevy abandoned????

id go get it, they may get you for wrong tags on wrong truck and try to say its stolen property, of course cops never check make and model let alone vin around here, i drove a 91 GMC sonoma for years got pulled over two or three times ticket read chevrolet S-10.
if he wants it he can come and get it. my 70 is the same way guy was sellin it to somebody, they caught wires on fire, towed it to owners house, he told me to come and get it, now buyers are back to pick up, luckily it was never in their name. but owner lost title so its gonna cost me to get one but i got a free 1970 C20 with very little cab rust.

Re: 72 Chevy abandoned????

This sounds like a real mess, I would check with DMV and the local Sheriff's office (they deal with civil problems) and see what your options are.

Re: 72 Chevy abandoned????

I sold a Harley a couple years ago and the guy never changed title and abandoned it on a street, as he was in jail. The city towed it and called me. They said I had to pay the fees and come get the bike. or they would junk it and charge me for that to. So I went and got he bike,(it was stripped)put some new tins on it and resold it. Making sure the next guy changed it, with me at DMV.

Re: 72 Chevy abandoned????

I recently sold my Cobalt and to protect myself (especially as it was sold out of state) I sent in a notice of sale to the DMV and put the SD license plates in my desk. So to get plates, the new owner must register the vehicle (in ND) and SD knows that I sold it.

Re: 72 Chevy abandoned????

I would say simply you should allow it to be towed and then if after the "allowed" time by law alotted for abandoned vehicles, you can apply for the title. That's assuming you really want it back after paying the fees. In California, they have "impound sales" when vehicles are left too long-they might have something similar in your state

Afterall, you *did* sell it to someone else-it's not yours, regardless of whether the new/old owner didn't transfer the title.

That's my $.02.

Arizona requires the seller notify the state too, I think it's only 10 days here. It's designed to help the seller protect themselves from 'used in a bank robbery' situation.

Re: 72 Chevy abandoned????

In Idaho they have a title insurance form (or some such) that the seller fills out with seller's and buyer's info, and mails to the DMV for this very reason. It's $2 and covers your buttocks in case the new owner doesn't register it.

Re: 72 Chevy abandoned????

Simple situation. You are the registered owner period. If the buyer never transferred title then HE never completed the transfer of ownership. That's his problem.

Take it home. Many states, it's 90 days and the person who's property it's on can apply for ownership. If you can't find the buyer or he doesn't contact you within 90 days or whatever your state says, then keep it, sell it, whatever. (Not because you have to, just to be safe.)

If you leave it to get impounded, you will end up paying the fees. Also, if you decided not to get it from impound and they sell it for less than the storage fees, they will hit you with collections. Then you will have a nice ding on your CR that will cost you a lot more than anything else.

Re: 72 Chevy abandoned????

I would just go pick it up and store it befor it gets to be a bigger hasel to deal with later. If the other owner comes looking for it then give it back to him for the cost of gas or something. If you wait for someone else to do it it will cost you in the end. You are not in the wrong for picking up a Vehicle thats still in your name. As long as you your self tries to find the person who last had it.

Ask the manager to check the plates. I know around here you have to give them you plate numbers when you sign a lease.

Imo if your making the attempt to find the owner thats fair enough. Pick the truck up and sit on it for a while. Like I said it could and usualy will cost you in the long run if you wait for other people to get things done.

Re: 72 Chevy abandoned????

In it`s current status someone who doesn`t own it will legally aquire it just for being called to tow it.Since you`ve contacted the management who has the legal right to have it towed and they will contact you if it needs towed....that`s all there is to this one.
I would do all I could to find out what happened. It sounds like it`s changed hands once since it left yours, unless it was stolen from the guy that bought it from you.You really really need to know the whole story, even if it`s abandoned free game.It could belong to a crazed meth head or other pshycopath,a judge`s son, some gang thug...you need to know who else thinks it`s their`s.

Re: 72 Chevy abandoned????

Whenever I sell a vehicle the first thing I do is notify the DMV with a "release of liability" (or whatever it's called) form. Why would you sell a vehicle and leave yourself open to the enormous liability of some stranger driving around in something registered to you!!??
That's the part I don't understand.
If you sold it,LET IT GO! Maybe it's already been used in a crime. In any case you have NO claim to it at all.

Re: 72 Chevy abandoned????

Lets say the guy who bought it from the guy (you sold it to) is a low income guy, He has been working and saving for along time to afford a old truck for a hobbie, or maybe as a work vehicle it took everything he had to buy it , now he needs to save for a few more months to pay for tax, tags, insurance. Sure its wrong for him to be using your tag, but (the guy he got it from may have said sure leave it on there until you get time/money straight to get your own.) If I worked hard to pay for it and you came and got it, (and I did not buy it from you even if I did) Bet your ash you would get beaten 1/2 to death in the parking lot if your personal tow vehicle hooked to the truck.

If your concerned about it just call it in to the police and say its your tag on there they will take it off and turn it in and put a "tow me" tag from the city on it.and after 48 hrs a autherized city tow vehicle will come get it. The currenet OWNER should see the tag and know to move the truck.

Or just a note that says hey !!! call me that my old truck interested in taking with you.

Re: 72 Chevy abandoned????

That's why when I sell a vehicle I always fill out and turn in the release of liability form with the DMV. That way if something does happen with it you are in the clear.

Re: 72 Chevy abandoned????

MO has a law against "open" titles, you have only a certain amount of time to transfer ownership and pay taxes.. thats part of the purchase agreement... and putting plates on a truck that is not registered is also illegal... the big issue is that YOU are liable... and you need to relase liabilaty,, either get the truck back and new title or fill out the form with the state to remove your liability...

Re: 72 Chevy abandoned????

Yes in Missouri, the seller has to fill out the "I sold it" form. It was was designed to keep used car dealers from not transfering the title to themself and saving themself the taxes. It affects all of us. The date on it and the title gotta match. It can be up to $300 fine to seller. If neither you or he did the appropriate steps you both may be at a loss to recover the truck. The form now comes attched to the new title. He has only so many days to change title or it used to be $25 a month not to exceed $100. Get to the online Missouri DMV site and search it out some more.

I agree with hotrodhomi. This way you are all covered legally and stops whom ever it was sold to from coming after you and reclaiming the truck.

Sorry, I hate to disagree with you, but if there's a clear document between the two of them showing offer and acceptance, that is a contract-the title is irrelevant. Ownership would *not* revert to him, but to the state if there were some sort of law on the books regarding notification to the DMV after the sale...
