1) Note that i love engine noises/loud engines, Yes, i even LOVE 4 cylinder "tuner" engine noises. -----MOST of the time---not early morning or late at night.

2) My opinion is that this noise is irritating to someone, thus to be a good neighbor i would try to get the noise down; i think there are devices you can put on the tailpipes to quiet things down but can take them off at other times.

a) i don't know, maybe i'm getting old(er)?

b) i understand that the noise may be under legal limits BUT it still does not satisfy the HOA's "requirements." So, in my opinion, if it were me, i would try to get the noise down. Yes, i have never lived "under" a HOA, so i don't know how that is like, however i have had similar neighborhood situations so i don't feel it is someone trying to get at you. i don't think they would "win" if you quieted things down----i think it's just someone irritated by the noise at that hour. (hopefully)

c) RE:Flowmasters
i have 2 flowmasters behind 2 cats (2 separate pipes from the engine back no crossover or x-pipe) While this is not extremely loud it is certainly not as quiet as stock. So i actually have to idle in gear in and out of the neighborhood if it's really early morning or late at night. i do this to be considerate to the neighbors.
Better yet coast down the driveway and into the street thru the neighborhood as much as possible then start the engine . This is with 8.5 compression and still not quiet.

d) even a car person like myself gets very annoyed at engine noise at inappropriate times---example harleys at 7am and these are the reasons for my opinions on the matter.

So anyways if you believe in the cause fine. i'm not saying you are wrong, i'm just stating my opinion.

screw those hoa board members! most people just work for a living, while a few miserable maggots out there on a pwr trip live to cause problems. i would start asking around face to face to find out who the whiner is..........also you may have to spill some roofing nails........

Their language is vague. It can only take one annoyed person to file a complaint. The language is based on perception. Perception is different from person to person. You can easily beat it since there are no decible requirements or other fact proving items. Send them a letter from a lawyer stating what I just said. Tell them you will sue for lawyer fees and court fees if they decide to do something about it. They will lose.

I have a neighbor that complains my dogs bark(they do they're trianed to bark,at noise,strange people and a$$hoes,so even if he is quiet they're gonna bark),about a tree he thinks will fall on his house(I have it checked yearly or more often by a tree service,different one each time).He hasn't spoken 2 civil words to me in the 7 years I've owned this house.I've gotten certified letter about the tree.I've only complained to him once,his visitor was shooting squirrells on the back fence and I told him to stop it or I might shoot back and he better hope I had a weapon that made noise at that time.He denied it was happening but it did stop.(He was obviously shooting towards my home.I chose this Home because there was no HOA or restrictions on my dogs.He's a former schoolteacher and I gess he misses having people mind him.
You will almost always have a neighbor like this.I've found they are easier to ignore than anything.Having an HOA makes them impossible to ignore.Usually you'll find that they are violating the HOA rules in some way also.I haven't heard from or spoken to this neighbor in over a year.Let's hope my luck holds.
BTW I would have removed the tree for a decent neighbor and simple request,but try to force me and it ain't gonna happen.

I live in a "neighborhood" but it is NOT an HOA hood. If it were the subframe and engine that have been sitting in my front yard would have had to be moved a long time ago.

My neighbor's daughter has been dating a kid for the past couple years that drives a newer Ram with flowmasters on it. I think it sounds cool but it annoys my wife when he leaves at 11pm. I do have to admit, when you're in bed or watching tv it is pretty damn loud. I'm a lot easier on the throttle in my 67 when I get home late at night now.

And as mentioned above, all it takes it one determined ass to make your life a living hell. Sometimes it's better to have good neighbors than a good family, at least you can ignore your family

Has anyone actually considered that the complaintant might actually be bothered by the noise and just wants peace and quiet and/or rest and is not trying to "get back at" the OP?


Again, i do love engine sounds at appropriate times; i don't consider late night/early morning to be appropriate (hello?). Does this makes sense?

Alot of people think they have an absolute right to make noise. i don't agree. It's a sense of entitlement.

What if a family member asked you to pipe it down? Would you then say screw 'em?

An analogy would be ice cream: i love ice cream, but there are certain times when it's not appropriate----i.e., when taking a shower, after i'm really full, when driving etc. The point is the glorious noise we all know and love IS NOT appropriate 100% of the time.


Why not try to be a good neighbor and IF they still hassle you after doing everything reasonable to be a good neighbor THEN you can fight.

Just my view.

You might want to find an actual copy of the HOA agreement for the place you live in. Regardless of local law enforcement code, if that agreement was signed, you are bound to abide by their rules. That's the reason I'll NEVER live where they have a HOA.

I think this is a valid point, but i can see both sides. However the OP did mention that he makes sure he doesnt cause excessive noise by revving it loudly but just leaving it at idle. I respect that.

Other post are just as correct in stating to get the bylaws for the HOA. They could have higher restrictions. HOWEVER, if you break those restrictions, but not local or state law, they do not have the right to call the law on you. They CAN give you notice to leave and force you to move, but until they give you proper warnings and written eviction notice for breaking their regulations, there is nothing they can legally do unless your refuse to cooperate or abide by their orders and restrictions which they must give to you in writing.

I find myself in the middle of this battle. I own 2 harleys, my 72 C10 and have 4 dogs. Right now i live in town, but i respect my neighbors. I role my harley to the road before i start it. In the mornings when its cold i try to keep the C10 as quiet as possible, and the dogs, they only go crazy when the neighbors dogs go crazy.

The neighbor next door loves the bikes and truck as her husband used to have both. We dont talk much but there has never been a complaint on me or by me.

However, couple houses down is a real nice guy with some teenage boys. One who decided to put a glass pack on a Chevy Colorado... let me be the first to say this is the worst sound i have ever heard! And he goes in and out with the petal to the floor at all times of night. I dont gripe, or complain, because my harleys at idle are still louder than his truck floored, (but not nearly as annoying). HE howevere has received several complaints about noise even though my vehicles are louder. But i dont act a fool in the neighborhood either. (I wait till im at least a mile away before i do that).

Its all about perception. Your right, the neighbor could be a dick who hates everyone, or they could be a person who works an odd shift and that is the worst possible time for them while trying to sleep.

The best you can do is make sure your following state and local regulations as well as the condo bylaws. They cannot ask any more than that from you. If they still file complaints, then they are the ones harrassing you.

Best bet, move to the country and have fun!

That's why I don't live anywhere with an HOA. My stepside would probably be a repaeat offender with, its side exit flowmaster exhaust. Not to mention the new BBC that will be in it with a nice solid cam in it. If that is all you do with your truck then, somebody has nothing better to do. I had a neighbor problem last year with my truck. Funny how his wife got annoyed this morning when I asked if she could close the windows in the room that their dog barks at everything when they aren't home. The bark is annoying

I've found that the world is set up for Day Working People! Nobody really cares if you work Nights and sleep odd hours in fact the say "What are you in bed for are ya sick?". My wife is a nurse and works 12 hour shifts from 7pm to 7 am its a hours drive home and she gets to bed around 9 am. We have trouble with telephone salesman and neighbors all the time.

Noise is Noise and I make my share but I try to keep my noise down and my dogs from barking. there's 2 sides to every story We're only hearing one!!

I had just recently bought my house in the neighborhood i grew up in (non HOA). I had to put up a 6' fence, only about 8' long, so i had my truck backed up to where i was working and had the music on. It surly wasnt loud, just enough to break up the quiet while i was working for the couple hours. It was 2pm on a sunny saturday. I had the neighbor come over and nicely introduced himself. We had a nice conversation and then as he left (note the music was quiet enough that we could easily converse over it) He asked i turn off the music as it was bothering him.
I was not happy with it but i complied.
Luckily he leaves town for the winter, since hes a retired widower, so he hasn't been around for me grinding all winter on my project.

Ive also had a hard time with my next door neighbor and their russian dog. Cant remember the name off hand but it was trained as an attack dog according to the neighbors. Well my Grate Dane wants to be friends with everyone so he gets over the top to say hi. They decided to tack on some short fence pickets to the top of the fence and used 3' wood screws pointing 2.5" through my side of the fence.

Needless to say, you can pick your home but you can pick your neighbors.





Just a thought, since your in Denver with a problematic neighbor, be careful about the puffer laws here. Hate to see you win this round just to loose the next.

Thanks for the advice fellas. At this time I'm awaiting a response from my letter of appeal. As far as the covenant violation it just broadly states no obnoxious noise that causes a nuissance or annoyance may be tolerated. There are no fine details.

As someone stated above, what if I worked nights? Any day noise would be considered an annoyance would it not? It's all about the perception of the victim.

I also will note that we live backed up against a large cement wall that we share with the interstate. I don't understand how my idling vehicle can stand out any more than a motorcycle, jake braker, or any other loud vehicle that passes along the interstate at all hours of the night.

I'll keep ya posted on any response that I get.

Yeah at this time they haven't raised that threat to me. If they end up mentioning it I will happily counteract by sitting in my truck as it warms up. Doesn't bother me much.

nieghbour runs his F**D HD diesel most mornings a while(wakes me up)
warms it up before he drives the kids off to school
another has a (1)cherry bomb on his 305 race engine truck s10
says it dosn't need a cat or etesting cause its a race engine?
(bout all he does is race the engine)
But I heard him tellin somebody last weeend it's an 85
and then all the rest of the local fart cans.....
gee I'm waitin on some Flowmasters 40 no cats......for my 79 305 2B
hope it makes some noise lol
