In Nevada that depends. Clark and Washoe counties have an almost identical smog program with CA. Those two counties comprise of 90% of the state's population. But NV. law does not hold the seller wholly responsible like CA. So be up front about the failure and get a legal bill of sale (notorized) stating the vehicle does not pass smog and it is up to the buyer to make it legal. It is called CYA.

Yes. As noted above you are not responsible for the buyer being able to smog it just be completely up front about it.
CYA with a line in the bill of sale, or another notarized document with the VIN that you both sign and each of you keep one notarized copy of, that states "The seller states that this vehicle did not pass the last attempted CA smog test and the buyer acknowledges this disclosure."
No reason to cave to the state of CA and junk it.

Its a 350/th400 truck I'm glad I live in md I can tag anything over 20 years historic and no emissions no inspection needed. They limit the miles and your not suposed to tow but nobody listens or really enforces it. If it don't have a title on md it's good for parts nothing more to much of a giant pain to get one. I cleaned the hell out of it thew hubcaps around it fixed the exhaust manifold leak and found a broken vacume elbow that was causing it to idle weird threw a free taillight in it and stuck a for sale sign in it. Hopefully it sells if it don't I wouldn't mind hanging onto it I'll just have to find a place to keep it. Kinda hoping it doesn't now that it's running good I know where a good shortbed bed is and 1/2 ton running gear. This trucks all set up for a 700r4 allready it be a nice cruiser then. But my neighbor is trying to sell some things to buy it and if he does it'll get run into the ground. Shame.

Not sure if you're up on the latest but NH changed the rule. Used to be 15 years and older did not require a title. But starting Jan 1st, vehicles 1999 and older do not require a title, 2000 and newer will require a title.
