Thanks. Now I know what to call it. I was gonna offer them to forgo future findings for an out the door price and/or ask them to change from total loss to repairable. They are working with the third party estimater, I assume they will answer soon or at least with in the mandated 45 days.

I received a $500 check against bodily injury today. I had stiffness in the neck the day after. I have notified the insurance agent that it is dishonest for me to accept and cash the check as I am not suffering nor did I seek medical attention. I will be destroying or returning the voided check upon receipt of their instructions.

I am confused, who cares what the check is for cash it. You got hit by an uninsured driver and spend countless hours on the phone screwing around dealing with it. I would suggest you hold onto that check until you get an offer on your truck or you may be kicking your self in the ass. Insurance company's are a corporation that care about there share price and share holders, not you.

What you suggest is dishonest and a reason insurance rates are high. Deal forthrightly even if others don't. Otherwise I'm no better than uninsured unlicensed aggressive drivers, corporate lawyers or our President.

I agree but it's for pain and suffering, and you suffered.Besides you cashing the check is not gonna do anything about rates, now or ever. When it comes to corporations and their explicit greed for shareholders, ie sending jobs overseas so the shareholders can make more money, its a new game.

Sure, it won't change rates to refuse unnecessary remuneration for injury not suffered or treated. But, I remain in control of my convictions, preserved in my resolve not to be a lier or a cheat and without blemish on my conscience. Nothing else really matters, specially if you can't live your convictions.

If they only came up with $500 to pay for a possible neck injury, they might as well kicked you in the balls, too! $500 won't get you an X-Ray for any type of injury. it's an old practice of waving money in front of you to entice you to settle quicker. They will wait as long as they can, then make an offer. But they feed you a litle here and there to keep you open to negotiations.
I, personally would have held the check, until you finally settle, then cash it. Afterall, it's essentially your money anyway, since your insurance is settling the claim, right?That check is most likely good for at least 90 days, you've got plenty of time to make a decision.

I understand the conscience thing, I really do, but they only made that offer in hopes you DON'T have an injury. Funny how money eases pain. We went thru the same with her wreck and shoulder injury. The others' insurance made ridiculus offers to make her better,trying to keep us quiet.

We can sympathise with you and understand the headache, we've been thru it here- and we still deal with it everyday- her injuries cost her a career as a register nurse- a job she can't do anymore because of chronic pain. We settled too soon, but were confident the 2 surgeries would fix her up.
I realize you don't have any injuries, but applaude you for sticking tough, gritting your teeth and riding it out- we definately know it's not easy!

Can't cash it if I wanted....evidently english challenged personnel at the insurance company can't spell my last name or street address or even city correctly. Working to correct my contact data at this time in the event they ever get around to "Decodeing" the VIN and compileing a settlement offer for consideration. Did send them instructions on decodeing Old Chevy VIN numbers so no excuses at this point on that matter.

Maybe instead of forced health care for the masses and MRAP vehicles for the DHS we need English identified as the language of the land. Then again, I might just be a bit insensitive at this point in my life.

The only decoding VIN snafu is they do not know what to do without 17 numbers! LOL. We went thru that also. With State Fraud, oops, State Farm,Insurance they had to add some 00's to the beginning of our number to fill in the blanks so the computer wouldn't spit it back.

Here is what my experience was, if you cash the check and later on ( say 1 year) start having verified issues with your back or neck or whatever, they can and will claim that since you cashed the check hence you settled for the $500 for any and all future issues, so you would not be able to sue or receive compensation for those hidden injuries in the future period.

I also want to say I admire that you stick to your convictions even if others don't agree. I hope all this works out in your favor and I'm very glad that no one was seriously hurt! Ol' John Lee did his job 100% IMO. he protected you.

Out of respect for Ol John Lee I won't post in this thread again. $4K and he comes home to rest tomorrow. Salvage title/total loss. So I have my truck and some cash and I gotta decide what to do, but I think I already know.
