Re: SWB 4x4 was totaled. Now what? Can I get it back?
I don't post on the board very much anymore, but I just read through this thread.
#1 I used to be an insurance appraiser #2 I agree with getting the truck out of the tow yard and to Ryan's. Pay the towing & storage fees. The higher they get.....the insurance company will TRY to figure that into "the cost to repair". #3 - threatening with a lawyer rare makes progress. Most insurance companies would rather deal with a lawyer because everyone drags their feet until the owner is desperate or gives up and takes a settlement. ****#4 your best bet is to get a hold of the IA Insurance Commission Dept. Insurance companies usually get things done if they hear from the commission. Because if you make a big enough deal of it, the insurance company will have to go to a hearing etc etc.

Re: SWB 4x4 was totaled. Now what? Can I get it back?
When you have a trucking company and service 48 states you need what they call ICC authority. Part of having that is to pay an "agent" in every state you travel in to make sure you can be served legal paperwork in each state you travel in. Which makes you basically being able to be sued in each state as if you were a resident of that state. Iowa insurance covers that in that state no matter where insurance is. So you would need to contact Iowa am sure. There are also laws governing trucking companies and I would be getting an accident report from whichever cops came to scene. The name and address of carrier assuming they had authority. Which is governed from D.O.T. you should be able to get his authority numbers from report. We used to own a trucking company and am sure the laws have changed a bit since we sold our trucks 10 yrs ago. But the laws have gotten more stricter since then. Maybe the forum member in Iowa could go to cop shop and get a report for you. They are usually 1.00 a page or something like that.
I am with everyone else. "Get your truck out of wrecking yard first and foremost". Then deal with all the other bull. See you got another thread on here for someone to look in south Lake Tahoe. Just to compare trucks or you gonna buy another one? Am in NM so can't help you out there. Good luck with sorting this stuff all out. I would work on getting truck out then be jumping in my truck and going to get the one you already have. Just my 2 cents. |

It's being worked on. Getting things handled from across the country take a little time.

Re: SWB 4x4 was totaled. Now what? Can I get it back?
I just paid Barney off. $900 for storage and wrecking fees. Took some time to get it out of the wreck, plus 30+ days of storage. Could have been a lot worse. Barney kept it inside a building the whole time. I have been on the phone back and forth with Ryan all day. The truck is now all cleared for removal from Barney's as soon as Ryan is able to get there. He is a busy guy too with much better things to do! But I sure appreciate his help!

Re: SWB 4x4 was totaled. Now what? Can I get it back?
Thanks everyone! I am so grateful for all your support and I am especially grateful to Ryan for picking up my truck and taking it to his place. Ryan said he would be posting a photo of my truck on his trailer tomorrow. Oddly enough I am not totally out of the woods yet. I tried to arrange for transport with my broker but she said she cannot arrange to have it go past the Iowa state line. She needs to hear from the insurance company that they are "done with the truck". So I have been on the phone talking to the insurance company and they said they would get back to me within 10 minutes after checking first with the adjuster. Apparently the adjuster had to arrange for someone to appraise my truck. At least the truck is in my possession. Maybe I will have to find an independent trucker rather than go through a broker. Good thing I am patient. .

Re: SWB 4x4 was totaled. Now what? Can I get it back?
The truck is out of the towing company's building. It needs some trans fluid, because it won't drive, and probably a tune up as it is running very rough. The plugs could be fouled from laying on it's side for 2 days. It makes me wonder if the tow guys pulled the plugs before trying to start it up? I checked and it has clean oil in the engine. It could be old oil though because by the smell of the gas that has been in it, the truck hasn't seen much run time for a long time. (Small that varnished gas ) I didn't have time to unload it and get it inside the shop, but I will in the morning.

WOW If they consider that truck a total loss then 3/4 of what you see on Craigslist are totaled for sure and they still want 5K and up!! Glad to see it back in your control George and hats off to you Ryan for this amazing act of kindness

Re: SWB 4x4 was totaled. Now what? Can I get it back?
The K10 is put away and locked up. I found a gas cap for it, put more tranny fluid in it and the trans works fine. Sorry for the bad pics, my phone was being a POS.
