Angry Please help me get my money back!! Ideas?

Okay here is the backround.... As some of you know I got a 77k10 in December. I traded my 1962 wheel horse 552 for it. The truck was non- driving and had been sitting for 8 years. It has low millage of around 28,000 but was a farm truck so it has seen better days. Plans are maybe a small lift and 33's with sheet metal replacement and an overall clean up, 02 gmc dark green paint job and black painted wagon wheels.......

Anyways I got her running good and decided to tag and title the truck so my father can drive it to and from the train station in the winter.

Well here in lies the problem: When registering the truck the "great state" of Massachusetts calculates sales tax acording to 5% on the average resale price according the the NADA value. Now the vehical is older then 25 years old and considered to be an antique so they must use the collector car value. The average retail of a 1977 k10 scottsdale stepside WITH OUT a/c, tilt,power windows or locks is ................ $9,500.00!!!!!!!!!!!!!!

So the state taxed me on 5% of $9,500.00 which is around $500.00. This is criminal. I honestly traded a lawn mower for this truck. Anyways... the RMV told me I can file a abreavement with the department of revenue and possibly reclaim some of this sales tax money. So We have the form and want to build a case to submit to them and I thought some of you might be able to lend some helpful truck info.

I plan on including a copy of the bill of sale, the previous owners phone number for them to call, pictures of the truck, the print out from the NADA guild.

What else might help my case??
What was the Brand NEW retail value of a 77 K10, stepside, big 10 HD suspention G80 rear 12bolt, th350, 350 4bbl trans 10 bolt corperate front np203 full time 4x4, quarts clock. It has no other options that I can find.

How many where produced?

currently I have not located any in my area in similar condition to show the ads for.

I emailed NADA but got no response from them.

This truck does not even meet there guild line for low retail value.

Any advice would be great. I put this in the 73-87 because you all know them best and like me know there is no way this is an accurate value estimate.

Follow this link, tell them you you need an out of state registration. It will cost 75 dollars at least the last time I did it. Tell them you paid 24 bucks for the truck so That is all you will pay tax on. When you get your new maine registration in the mail take it to the mass dmv and tell them you would like new plates. You already own the vehicle and paid sales tax on it so they cannot charge you sales tax again. Easier then dealing with the mass tax office.

huh???

I just registered it in MA 2 weeks ago. I am not worried about registration fees it is the sales tax issue that has me arguing with them.

they charged me sales tax on money I never spent nor on an item that is not worth the amount I was taxed for it. I am looking for any addition info I could send to them on appeal of this unjust sales tax.

I didn't know you already registered it in mass. I gave you that link to register it in maine first for cheap sales tax. So when you registered in mass you wouldn't of had to pay sales tax because the tax would of already been paid to maine. It still would of been a lot cheaper then the 500. I would say you are SOL now. Good luck getting the money back from the state, all the time and aggrevation might not be worth 500. You'll know better next time I guess.

sell them the truck at their value. and use the money for a moving van. lol, oh, sorry. dont know what to say. when money is tight they will try any way to get more. good luck

Beaurocrats. Boy am I glad I live in the middle of the country sometimes.

I guess I'm lucky because when I go to the assessors office the gal says "oh yeah, I know that truck I see it at your house on my way home".

I wonder if your bill of sale would help with the bereavement filing? I would follow that process to the end and if that doesn't work then title it out of state like whiskeydented suggested.

Might try writing to your state representative too. Take a picture of the truck, a picture of the mower, and a picture of the $500 tax bill and tell them that they are targeting "underpriveledged common folks" who just need transportation to get to work. Bet you'll get a response, maybe some help.

Surely there is a TV or Radio station in the area that has a consumer advocate or someone that reports special human interest stories. If not, write the editors of several newspapers, perhaps one will pick up on the story. Also check with local car clubs, or any other groups that are familiar with buying and selling classic vehicles to see if you can find a loop-hole in the tax law. And definately write your state's congressmen and governor to let them know what you think of this law that they passed for you.

Okay let me clear some stuff up....

My 84 is intact registered in another state. However I don't want to burden my relatives with more then one vehicle that is not there own.

In our state if you get caught with out of state plates and live instate then you get fined and forced to register said vehicle instate or it will be impounded. BLAME the dang illegal imigrants for that one!!

So for a truck we will be driving daily the out of state plate is not an option.

I would like to drive it down there and make them give me the value they taxed it on so I could buy a clean surviver and another vehicle.

usually if you talk to the appresal guys and tell him whats goin on you can get it done for cheap.. like i had a 69 impala apreased for the same exact reason... they wanted my to pay for a car that i got for free... and all i was doing was parting it out.. but anyways he apreased the car at like 300 bucks and the title place couldnt say anything.. but ussually when both parties are there and agrea on a low ball price then they cant say anything anyways... when i sold my 79 bronco a guy bough it for 9,000 but when we went to switch the title over we both agread on 500 bucks so he wouldnt have to pay all kinds of crazy tax.. no biggy.. i got the money i wanted for my baby and he was happy to..

Actually, it is a 'biggy'. Thousands of people lying about the purchase price of used vehicles every year is exactly the reason many states are adopting new taxation laws to recoup that lost revenue.

It's also a way for states to get old 'junkers' off the road. Not too many people want to pay more is sales tax than what the vehicle is actually worth.

In MN, you have to send in pictures of the vehical and fill out a few forms stating the condition of the vehical. My dad had the same problem with his '67 Mustang. The car looks good from far, but far from good. ie no floor and lots of body filler.

Texas now has the assumed value tax, so you have to get it apprased
by a dealer. But it's not as obscene like as your state.

I have it easy because my brother is a dealer.
I went to regester my car and then found out what they thought it was
worth, then I proceded to tell EVERYONE in the tax office that I wasn't going to pay that stupid tax, and that she should just let me out of it now because
I was being honest and if I had to get it apprased they would loose money.
So my bro apprased it for 300, much less than I payed for it. lol


The government chokehold on us has gone way past "writing a letter".

Tax was paid on it when it was new, why do we have to pay tax every time
it changes hands?
