if u got it in writing id go talk to my lawyer. If he wants to be a jerk about it. U be one too. Thats not normally wut i'd say but he DID agree to it enough to write it down and sign it. Had it just been a verbal agreement i'd say be the bigger man and cut your losses. But he obviously thought everything would work out so....force it to work out.

Berencam is 20 years old and trying to scrape the money together to buy a truck. A letter from a lawyer is of no point unless you are going to be prepared to follow through with it. A day in court [expense wise] is going to be better spent buying a truck. It's not about rolling over and letting someone kick the crap out of you .... as you get older you realize some issues are better served walking away from and others are worth a good fight. This is one that is worth walking away from as no one got hurt if anything a lesson or two was learnt by all. A side from all of this any lawyer that you can hire for $20.00 is not worth the time of day.
esll. I was a bit of a hot head when I was 30 years old 67C-30 and I would let nothing slide .... I pay for that physicaly now and that is what it took for me to wake up. I only hope that you do not take the same road.

In my business, there are so many clients that simply do not want to pay after the work is completed. I am in the swimming pool business, and as you know that is luxury service, and not a neccessity. My business is not like the Heating and Air guy where your actually NEED your A/C or heat. I pisses me off so bad that I can't go out and replace a pump, filter, or something and when they don't pay, I can't even legally go get the stuff. If its just cleaning or maintenance, its even harder to do anything because there are no physicals parts or componants, just my time. These aren't new clients either, its people I have been dealing with a while in most cases, and they are usually people with plenty of money (go figure). I make new clients pay up front, but it seems like some peole pay long enough to get you trust them, then WAM! I guess when I see some presumably older guy jerking a 20-yr old guy around, especially after the way he lost his last truck, it makes me see red. None of us even know what Berencam may have done to the truck so far, and I can imagine how bad it would feel to have give something back you may have already worked on improving and have already made plans for you wanted to do it after you pay it off. At the end of the day, the guy is still reneging on this kid, and just do not I think someone should do business. That's the why I told him his legal rights. This is one of the few times these laws work to actually protect the buyer from the seller...

Funny how a guy's tune can change. I wouldn't do that now, I live a reletively quite life and have come to the conclusion that when I was your age I was the center of the storm that I created right or wrong! By the way I'm 56 this Dec/07 you can call me Pop's as I'm old enough to be your dad and I take this is a form of flattery. esll.

Don't diss berencam....yeah, he's only 20 and he tried to make a deal to get a truck to replace the one that got hit by a drunk with no insurance. Can't blame him for feeling the way he does about the deal gone sour. If they had an agreement, particularly a written agreement, then (my thought) it becomes a matter of "a man's word". If you don't honor your "word", you don't have anything of value, in my opinion.

Chevloray You are sure right about a mans word. It is what makes you who you are. Berencam will find another truck. Its in his blood. His certainly saved his. Its just a bad deal all around.

thought i might clear couple things up for a few of you.
1. the agreement was both written and verbal ( the only reason i got it in writing is that ive had bad experiences in the past and know what value written statements are, guess at least im learning. 2. i agreed to let him have complete possession of the vehicle until it was payed off. He agreed to leave the truck in the shop and not use it. 3. because it was in his possession and not mine i pulled out comprehensive insurance on it just in case a fire or whatnot destroyed the truck. 4. i had to make payments via owner financed because i already have one loan out on my now fiances car. The chances of them granting me a second loan or an addition to the loan for a random truck not even at a dealership was out of the question for me Now, having said all that, could i be a jerk and press the matter and enforce the written contract, yes. Do i want to, in a word, no. I am done dealing with people that will take advantage of my age and status in life. If he is going to be this way about these payments and not keep his word....well.... who knows what else i will encounter when i would have started into this truck. I guess honesty and integrity is and always will be your best asset and dammit it sure is hard to find these days. |

You can prove he made an agreement, and you can prove you paid insurance because of said agreement.
You know he has cash at the time of sale. It seems only fair he should pay your insurance bill for going back on his word....

No body is dissing anyone, I for one feel sorry for what has happened. Justice in a word is over rated. A contract is a "SMALL" comfort for all parties in a given situation. I for one know if two people mean well and want an out line of the intentions of all involved a contract is not only a good thing but will work well towards the conclusion of an agreed upon matter. On the other hand if one of the parties is not dealing in a fare manor and by their actions does not mean well be prepared to spend $$$ to have your day in court and have justice upheld. Not everyone can afford this avenue and have no choice but to let justice be afforded to the unjust. This is my point and not to be taken as being naive or dissing someone.

Do you have possession of the truck? If so and the title is in your name I don't see that he has a legal leg to stand on especially if you have it in writing. (I've been watching judge judy)
Not to be rude but the amount of the truck would also play a part in it. If its a $1500 truck with only a couple of payments and its yours in the clear is different than a $5000 where you have to deal with this guy for almost another year. I agree with others when they say take your $500 back stick it in a savings account, put the $500 payment that you would have been making each month in there and in 3-4 months buy you a truck outright. Oh yeah, on the original question...Morals are taking a back seat to the me-first attitude. I teach middle school and it ain't gonna get any better, the kids I have have ABSOLUTELY no problem cheating or telling a lie. I wish I knew what the answer was!!!

1. If you have the truck AND the title, AND the agreement IS in writing both of you have an obligation to fulfill the contract or agree that it can be dissolved.
2. If you have the truck AND the title, BUT the agreement IS NOT in writing he's an idiot, because he just sold you the truck for the amount of the first payment. You have no obligation to give him anything else. 3. If you have the truck, but NOT the title, BUT the agreement IS NOT in writing be extremely careful. He can decide he doesn't like the fact that you have it, and say you stole it from him to get it back. 4. If you don't have the truck or the title, AND there's no written agreement in writing you just gave him $500 for no reason, and he can walk away at any moment - with or without your money. If this last point is true you have no ground to stand on. There is no such thing as a gentlemen's agreement when it comes to buying or selling vehicles in this day and age. I agree with one of the first responders here. Get your money back, get some cheap and reliable transportation for the time being, and start saving. There's no rule written anywhere that you have the right to own the exact vehicle you want right this very minute. Sometimes you have to work - for a long time - to get what you want. If you want it bad enough you'll save for it. You're not "going through hell" either (whoever said that). This is life. You're learning how to get what you want or need based on the resources you have avail. You're also learning how to deal with people.
