Lost Title in Texas

OK all you Texas boys we have a truck with a lost title and we need to get it transferred to someone else's name. The person that owned it has died and DMV won't let us transfer it because they say it was not listed in the will. They have told my sister that her power of attorney became null & void when the person died. Anyone know of a way to get around this. We are trying to keep the truck in the family and give it to a nephew.

I've found that the key to this is the actual person in the DMV.There is a way to get a title but you have to find the person in the DMV who knows or is willing to find out how it's done.I went thru three or four people to get a lost title replaced.Remember those folks only lose their jobs if they don't show up for a month at a time or are actually caught in the act of steeling.There is no performance penalty for them.

Probably going to have to get a bonded title. It will cost a little bit of money and henwill be liable for anything that happens to the truck within the next 2 years even if he sells it. They will give you a title with your name on it but it will say bonded title on it and at the end of the 2 years the state willail you a clean title.

Is the estate in Probate? The executor of the estate should be able to get the ball rolling through a probate attorney. We transferred my dads' car to my brother via that method.

No probate as he really had very few assets and did not mention the truck in his will. My sister had a power of attorney before he died and I think she should just go apply for a new title and not tell them he has died.
