OK..the guy i bought the 355(the one with the baddly cracked block)from says he'll give me my money back, if I put it back together with new gaskets..now the only reason I can see, is for him to sell it to another sucker...just dont seam right..I hate to lose my money...but

If your willing to spend the money on gaskets to get your money back, go for it. However, if at all possible, I would grind, stamp, scratch, or do what ever I could to mark it as a bad black so that it couldn't be easily covered with paint. If that's even possible.
